Please read these terms carefully before using our services. By engaging with Duran Accelerator, you agree to be bound by these terms.

1. Our Client Delivery Guarantee (How It Works)

We run the system until 4 (Market Entry) or 10 (Market Domination) clients are delivered. This is our iron-clad commitment. However, „client delivered“ has a specific meaning in our system, and your close rate directly impacts how quickly we hit these numbers.

1.1 The Delivery Mechanism

We deliver clients through a volume-based system designed to achieve your targets at industry-standard close rates:

THE 20% CLOSE RATE IS MANDATORY

If you close at 20%, you hit your targets. If you close below 20%, we must deliver more prospects to compensate—and we will, but this extends campaign duration and may trigger performance reviews.

1.2 What „Client Delivered“ Means

In the Duran Accelerator system, a „client delivered“ is achieved when:

  • We identify a qualified decision-maker matching your criteria
  • That prospect actively engages with your offer (books a call, replies with interest, requests proposal)
  • You have the opportunity to close them through your sales process
  • The prospect either becomes a closed client OR is disqualified due to your sales interaction

Critical distinction: We deliver the opportunity. You must close the deal. A „client delivered“ counts toward your target when we hand you a qualified, engaged prospect. Whether they actually sign and pay depends entirely on your sales performance.

1.3 The 20% Close Rate Requirement

Our delivery system is engineered around a 20% close rate benchmark. This means:

  • At 20% close rate: 20 prospects = 4 closed clients (Market Entry) or 50 prospects = 10 closed clients (Market Domination)
  • Below 20% close rate: We must continue running the system, delivering additional prospects until we hit your target client numbers
  • Above 20% close rate: You may hit your targets faster, but we still run until the guaranteed numbers are delivered

Your Responsibility: Maintaining a minimum 20% close rate is a contractual obligation. If your close rate falls below 20%, this indicates sales process failure on your end. We will continue running the system to fulfill our guarantee, but you may be subject to performance improvement requirements or termination if you demonstrate persistent inability to convert qualified prospects.

2. Definitions

„Duran Accelerator“ (referred to as „we,“ „us,“ or „our“) refers to Duran Accelerator, a Germany-based outbound prospecting agency operating worldwide.

„Client“ (referred to as „you“ or „your“) refers to any business, salesperson, agency, or authorized entity that engages our services.

„Services“ refers to our Direct Access Intelligence™ system that delivers qualified buyer opportunities.

„Client Delivered“ refers to a qualified prospect who has engaged with your offer through our system, giving you the opportunity to close them. This is what we guarantee: 4 for Market Entry, 10 for Market Domination. We deliver the opportunity—you must close the deal.

„Qualified Prospect“ refers to a decision-maker who matches your specified criteria and has actively expressed interest in your offer (booked call, positive reply, or proposal request).

„Close Rate“ refers to the percentage of qualified prospects you convert into signed contracts. Calculated as: (Closed Deals Ă· Qualified Prospects Delivered) Ă— 100.

„Closed Client“ refers to a prospect who actually signs a contract and pays for your services. This is your responsibility, not our guarantee.

„Outcome Report“ refers to your required update on the status of each prospect delivered, including whether they were closed, lost, or remain pending.

3. Our Iron-Clad Guarantee

3.1 What We Promise

We guarantee to run our Direct Access Intelligence™ system until:

  • Market Entry: 4 clients are delivered (qualified prospects engaged)
  • Market Domination: 10 clients are delivered (qualified prospects engaged)

We do not stop, pause, or give up until these numbers are hit. This is unconditional.

3.2 How We Fulfill This Guarantee

We fulfill our guarantee by delivering qualified prospects. At a 20% close rate:

  • Market Entry requires ~20 prospects to deliver 4 clients
  • Market Domination requires ~50 prospects to deliver 10 clients

If your close rate is 20%, we hit your targets efficiently. If your close rate is below 20%, we continue running the system, delivering additional prospects beyond the baseline numbers until we achieve the guaranteed client delivery count.

3.3 What We Do NOT Guarantee

  • We do not guarantee that prospects will actually sign contracts with you
  • We do not guarantee specific revenue, profit, or ROI
  • We do not guarantee your sales performance or close rate
  • We do not guarantee that you will maintain the 20% close rate standard
  • We do not guarantee how many prospects it will take to hit your targets (depends on your conversion)

4. Services Description

Duran Accelerator provides Direct Access Intelligence™—a system that positions you where buyers search and delivers qualified opportunities. Our services include:

  • Research and identification of high-intent buyer spaces for your offer
  • Strategic positioning to capture active buyer attention
  • Continuous system operation until guaranteed client delivery numbers are achieved
  • Real-time forwarding of qualified prospect inquiries and engagement context
  • Follow-up sequence management to maximize engagement (Market Entry and Market Domination)

Our Role vs. Your Role: We deliver qualified prospects who want to talk to you—this counts as a „client delivered“ in our system. You must then conduct sales calls, handle objections, negotiate terms, and sign contracts. We deliver opportunities; you deliver revenue.

5. Client Eligibility & Sales Competence

To engage our services, you must demonstrate ability to convert qualified opportunities:

  • Be at least 18 years of age with legal contracting authority
  • Operate a legitimate B2B business with proven offer-market fit
  • Maintain availability to respond to inquiries within 2 hours during business hours
  • Possess sales process capable of achieving minimum 20% close rate on qualified leads
  • Have capacity to handle 20-50+ sales conversations as needed to hit targets
  • Demonstrate professional sales conduct and follow-through capability

Sales Competence Verification: We reserve the right to request proof of your sales capabilities (previous close rates, sales process documentation, or references) before accepting your engagement. If you cannot demonstrate ability to maintain a 20% close rate, we may decline to work with you or require sales coaching as a condition of service.

6. Payment Terms

6.1 Fees

Service fees are payable in advance. Prices in USD. Payment processing fees are your responsibility.

6.2 Refund Policy — Delivery Guarantee Only

Our refund policy is strictly limited to our delivery performance:

  • Market Entry ($2,000): Non-refundable once campaign development begins (within 24 hours). We run until 4 clients are delivered.
  • Market Domination ($5,000): 50% refundable if cancelled before research phase; non-refundable once positioning work begins. We run until 10 clients are delivered.

NO REFUNDS FOR SALES FAILURE

Under no circumstances will refunds be issued because:
• You failed to close prospects we delivered
• Your close rate fell below 20%
• You were unable to convert opportunities into revenue
• You lacked sales competence or professionalism
• Any factor within your control prevented deal closure

If we fail to deliver the guaranteed number of clients (qualified prospects engaged) within 90 days of launch, you may request a pro-rata refund or continued service at no additional cost until targets are hit.

6.3 Chargebacks Prohibited

Chargebacks based on your sales performance, inability to close deals, or dissatisfaction with your own close rate constitute breach of contract and fraud. We will pursue legal recovery.

7. Campaign Execution

7.1 Timeline & Delivery

We commit to:

  • Initial launch within 96 hours of receiving complete targeting criteria and payment
  • Continuous operation until 4 or 10 clients are delivered (no time limits)
  • Baseline delivery of ~20 or ~50 prospects at 20% close rate
  • Extended delivery beyond baseline if your close rate is below 20%

7.2 Your Responsibilities (Critical)

You must:

  • Respond to ALL inquiries within 2 hours during business hours
  • Conduct professional sales calls with competent discovery and presentation
  • Follow up with prospects who don’t immediately close (minimum 3 attempts)
  • Maintain pricing integrity and not undercut your own value
  • Track your close rate and work to maintain minimum 20%
  • Self-report the outcome of every prospect delivered within 7 days (Section 8)
  • Not blame our delivery for your conversion failures

Performance Impact: Your responsiveness, sales competence, and reporting compliance directly impact campaign duration. At 20% close rate, we hit targets efficiently. Below 20%, campaign extends. We will deliver your guaranteed clients regardless, but poor performance may trigger review or termination.

8. Mandatory Self-Reporting & Performance Tracking

8.1 Your Reporting Obligation

You are contractually required to self-report the outcome of every prospect we deliver. This is non-negotiable and essential for tracking your close rate.

REPORTING REQUIREMENTS:

  • Report outcome within 7 days of each prospect delivery
  • Status options: CLOSED (won the deal), LOST (failed to close), PENDING (still active)
  • Provide brief reason for LOST status (price objection, no budget, unresponsive, etc.)
  • Submit via our tracking system (Google Sheet, CRM, or email as specified)
  • Update PENDING prospects every 14 days until resolved

8.2 Failure to Report = Automatic Loss

If you fail to report the outcome of any prospect within 7 days:

  • The prospect will be automatically marked as LOST in our system
  • This counts against your close rate calculation
  • Repeated failure to report (3+ instances) constitutes breach of contract
  • We may pause or terminate your campaign for non-compliance

Why This Matters: We cannot optimize delivery or fulfill our guarantee without knowing your conversion performance. Your reporting is as critical as your sales activity. Non-reporting suggests you are hiding poor performance or not engaging with prospects.

8.3 How We Calculate Your Close Rate

Your close rate is calculated as follows:

CLOSED DEALS Ă· TOTAL PROSPECTS DELIVERED Ă— 100 = CLOSE RATE

Example: 2 closed out of 20 delivered = 10% close rate

We track this in real-time and share weekly performance updates with you. If your close rate drops below 20%, we will notify you immediately and may implement remedial actions per Section 9.

8.4 Weekly Performance Reviews

We conduct weekly reviews of your close rate and reporting compliance. You will receive:

  • Total prospects delivered to date
  • Your current close rate percentage
  • Projection of how many prospects needed to hit targets at your current rate
  • Performance status: ON TRACK (20%+) or BELOW STANDARD (<20%)

9. Close Rate Monitoring & Performance Enforcement

We actively monitor your close rate through your self-reports and our tracking. If your performance falls below standards:

9.1 Performance Review Triggers

  • Close rate drops below 20% after 10+ prospect interactions
  • Failure to self-report 3+ prospect outcomes
  • Failure to respond to 3+ inquiries within 2-hour window
  • Cancelling or rescheduling 3+ sales calls without valid reason
  • Prospect complaints about your unprofessional conduct
  • Clear evidence of inability to conduct basic sales conversations

9.2 Remedial Actions

We may:

  • Pause campaign pending sales coaching or process improvement
  • Require completion of approved sales training before resuming
  • Implement stricter reporting requirements (48-hour instead of 7-day)
  • Terminate agreement if incompetence persists (no refund)

Bottom Line: We guarantee client delivery. We do not guarantee your sales performance. If you can’t maintain 20% close rate or fail to report outcomes, we will still fulfill our guarantee—but you may be removed from our client roster.

10. Limitation of Liability

To the maximum extent permitted by law:

  • Our total liability is limited to fees paid for the specific campaign
  • We are not liable for your revenue, profits, or business outcomes
  • We are not liable for prospects who choose not to buy from you
  • We are not responsible for your sales performance or close rate
  • We are not responsible for your pricing, offer structure, or business decisions

OUR COMMITMENT

We run the system until 4 or 10 clients are delivered.
We deliver the opportunities.
You close the deals and report the outcomes.

11. Confidentiality

You may not disclose our methodology or strategies. This survives termination for 2 years.

12. Termination

Either party may terminate with written notice:

  • No refunds for campaigns in progress or completed
  • We may terminate immediately for persistent sub-20% close rate, reporting failures, or sales incompetence
  • If terminated due to your breach, you remain liable for all fees

13. Intellectual Property

All campaign materials remain our property. You receive license for follow-up use only.

14. Governing Law

German law governs. Berlin courts have exclusive jurisdiction.

15. Changes to Terms

We may modify these Terms at any time. Continued use constitutes acceptance.

3. You are contractually required to maintain a minimum 20% close rate.
4. You must self-report the outcome of every prospect within 7 days.
5. Whether prospects actually become paying customers depends entirely on your sales performance.
